Healthcare is the industry where "AI will probably be great but we're terrified of getting sued" is the default position. And rightfully so. The liability exposure is real, the regulatory framework is complex, and patient expectations around privacy are high.

I've been working with dental practices, fertility clinics, and primary care offices on AI deployment. The ones that get ahead of compliance issues instead of reacting to them are the ones that succeed. Here's what you need to know.

The Compliance Checklist

1. HIPAA and Business Associate Agreements

If you're using any AI tool that touches patient data—including transcription services, note-taking tools, or data analysis—you need a Business Associate Agreement (BAA) with the vendor. This is non-negotiable.

Most cloud-based healthcare SaaS vendors have BAAs. Most consumer AI tools (ChatGPT, Claude web interface) do not. If you use a consumer AI tool with patient data, you're in violation. Period.

Action: Before you deploy any AI tool, verify BAA status with the vendor. If they don't have one, don't use it for patient data. There's no exception for "just this one time" or "we'll anonymize it."

2. Data De-Identification

If you're using AI to analyze data and you want to avoid HIPAA restrictions entirely, you need proper de-identification. This isn't just removing patient names. There are 18 elements that must be removed per HIPAA Safe Harbor.

Most healthcare providers underestimate how much work this is. "We'll just remove the name" isn't good enough. You also need to remove dates (except year), addresses (except state), medical record numbers, insurance information, and even age if it's over 89.

If you want to do AI analysis on real patient data to improve protocols, you need to do this properly or get a waiver from your privacy board.

Action: Have your privacy officer review your de-identification process before you do any analysis on real data. Don't assume "it's obvious what needs to be removed."

3. Audit Trails and Accountability

If an AI system makes a mistake that affects patient care (wrong recommendation, missed data, privacy breach), you need to explain what happened. This means audit trails: who accessed what data, when, and for what purpose.

Consumer tools don't provide audit trails. Enterprise tools do. This is a key differentiator when you're evaluating vendors.

Action: Require audit trail capability from any AI vendor you consider. Especially for clinical decision support tools, the ability to show "why the AI recommended this" is essential for liability protection.

4. Clinical Validation

If you're using AI to influence clinical decisions—diagnostic support, treatment recommendations, risk assessment—you need evidence that the tool actually works. This is especially true if the AI is more autonomous (vs. just informing a decision).

Right now, this is the wild west. Most AI tools marketed to healthcare haven't been validated in your specific patient population. Just because Mayo Clinic published a study doesn't mean the tool works for your 50-person fertility clinic.

Action: Require vendors to provide validation data relevant to your practice. If they can't, use the tool for support only (flagging things to review) rather than for primary decisions.

5. Patient Consent and Disclosure

Patients have a right to know when AI is being used in their care. This isn't just ethical—it's increasingly a legal requirement. Some states are moving toward explicit AI consent requirements.

At minimum, your privacy notice should disclose that you're using AI. Ideally, you'd get patient consent, especially if the AI is making or influencing significant decisions.

Action: Update your privacy notice to disclose AI use. Consider adding a consent checkbox for diagnostic or prognostic AI tools.

6. Liability Insurance and Documentation

Talk to your malpractice carrier. Some will cover AI-related incidents, some won't. Some will require specific safeguards. You need to know this before you deploy anything.

And document your decisions: Why you chose this vendor. What validation data you reviewed. What safeguards you implemented. If something goes wrong, that documentation is your defense.

Action: Schedule a call with your insurance broker. Ask explicitly about AI coverage. Then document your vendor selection process.

Where to Start

My recommendation: Start with the lowest-risk applications. Administrative AI (scheduling, documentation formatting, intake automation) has lower liability exposure than clinical AI.

Get your HIPAA and vendor BAA process locked down first. Then expand into clinical applications with proper validation and safeguards.

Healthcare is one of the highest-value spaces for AI, but only if you implement it with compliance as a feature, not an afterthought.
